These Terms of Service govern your use of New Wave Print’s website and your purchases from New Wave Print. By accessing the website or placing an order, you agree to these terms and to our Privacy Policy, Shipping Policy, and Return and Refund Policy.

1. ELIGIBILITY

You must be at least the age of majority in your state or have permission from a parent or legal guardian to use this website or place an order.

2. PRODUCTS, PRICING, AND AVAILABILITY

Product descriptions, pricing, and availability may change without notice. Prices are displayed in U.S. dollars unless stated otherwise. We may refuse, limit, or cancel an order for reasons including suspected fraud, payment problems, pricing errors, product availability, or an inability to complete the requested customization. If New Wave Print cancels an order after payment has been collected, the amount collected for the canceled order will be refunded.

3. CUSTOM ORDERS AND ARTWORK APPROVAL

Many New Wave Print products are custom-made. You are responsible for providing complete and accurate sizes, names, numbers, colors, logos, artwork, shipping information, and other order specifications. Production may require your approval of a digital proof. You are responsible for carefully reviewing the proof, including spelling, dimensions, placement, colors, and other details, before approval. Production timing begins after all required information and final artwork approval have been received.

Colors shown on screens may differ from printed colors. Products assembled from multiple fabric panels may have reasonable alignment variations at seams, collars, armholes, and panel joins.

4. CUSTOMER-PROVIDED CONTENT

You represent that you own or have permission to use every logo, trademark, image, name, design, and other material you provide to New Wave Print. You authorize New Wave Print to reproduce and modify those materials only as reasonably necessary to prepare, produce, and fulfill your order. You are responsible for claims arising from materials you submit without the required rights or permissions.

5. PAYMENTS

You agree to provide accurate billing and contact information. By placing an order, you authorize New Wave Print and its payment providers to charge the selected payment method for the order total, including applicable taxes and shipping charges.

6. SHIPPING AND DELIVERY

Processing, production, shipping charges, tracking, and delivery are governed by our Shipping Policy. Production and delivery dates are estimates unless New Wave Print expressly agrees otherwise in writing. Carrier delays and other events outside our reasonable control may affect delivery.

7. RETURNS, REFUNDS, AND CANCELLATIONS

Returns and refunds are governed by our Return and Refund Policy. Custom and decorated items are final sale except for eligible production-error, defect, damage, or incorrect-item claims. Because custom work is created for a specific customer, an order generally cannot be canceled after final artwork approval or after production has begun.

8. PRODUCT CARE AND USE

Follow any care, installation, and use instructions supplied with a product. New Wave Print is not responsible for damage caused by misuse, improper care, normal wear, unauthorized alteration, or use contrary to supplied instructions.

9. INTELLECTUAL PROPERTY

Except for customer-provided materials, the website and its text, graphics, photographs, logos, designs, and other content are owned by New Wave Print or used with permission and are protected by applicable intellectual-property laws. You may not reproduce, distribute, sell, or commercially exploit that content without written permission.

10. PROHIBITED USES

You may not use the website for unlawful or fraudulent purposes; interfere with website security or operation; transmit malicious code or spam; attempt unauthorized access; misrepresent your identity or affiliation; or violate intellectual-property, privacy, or other legal rights.

11. THIRD-PARTY SERVICES AND LINKS

The website may use or link to services operated by third parties, including payment processors and shipping carriers. Those services are governed by their own terms and policies. New Wave Print is not responsible for third-party websites or services outside its control.

12. DISCLAIMER

To the extent permitted by law, the website is provided on an “as available” basis. We do not promise that website access will always be uninterrupted, secure, or error-free. Nothing in these terms excludes warranties or consumer rights that cannot legally be excluded.

13. LIMITATION OF LIABILITY

To the extent permitted by law, New Wave Print will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or products. New Wave Print’s total liability for a product claim will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where prohibited by law.

14. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify New Wave Print and its owner, employees, and contractors against third-party claims and reasonable costs arising from your unlawful use of the website, breach of these terms, or infringement caused by materials you submitted.

15. GOVERNING LAW

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any legal proceeding must be brought in a court with jurisdiction in Arizona, except where applicable consumer law requires otherwise.

16. CHANGES

We may update these terms from time to time. The effective date above will identify the current version. Changes apply prospectively after publication.
